These terms and conditions apply to the Bloomelle app for mobile devices, together with any related services operated by Tsimafei Lemeshchanka (collectively, the "Application"). Tsimafei Lemeshchanka is hereby referred to as the "Service Provider".
By downloading or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application.
License to Use the Application
Subject to your compliance with these Terms, the Service Provider grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application on a mobile device for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or disassemble the Application, except as expressly permitted by applicable law.
Intellectual Property
The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding. Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose.
Termination
The Service Provider may suspend your access to the Application if you materially breach these Terms. You will have 14 days from notice of the breach to remedy it. The Service Provider may terminate your access immediately without notice if you violate applicable law, infringe intellectual property rights, or engage in activity that could cause harm.
Acceptable Use
You must be at least 16 years of age to use the Application. You agree not to use the Application to post, share, or upload content that:
- Is illegal or violates third-party intellectual property rights
- Is abusive, threatening, harassing, defamatory, or hate speech
- Contains spam, phishing, or malware
- Violates the privacy or personal data rights of others
- Is misleading, false, or deceptive
Subscriptions and In-App Purchases
The Application may offer a premium subscription ("Bloomelle+") that unlocks additional features. Where offered, subscriptions are billed through the App Store, auto-renew unless cancelled at least 24 hours before the end of the current period, and are managed and cancelled through your App Store account settings, not through the Service Provider. Purchases are processed by RevenueCat, a third-party subscription management service.
Not Medical or Professional Advice
The Application provides general educational and planning information about menstrual cycle phases. It is not medical, psychological, or diagnostic advice, and it is not a substitute for evaluation, diagnosis, or treatment by a qualified physician or other healthcare professional.
The relationship between cycle phase and daily performance is an area of limited and mixed scientific research. Suggestions in the Application are framed as things that "may suit" a given day, never as guarantees or prescriptive medical recommendations. Always seek the advice of a qualified healthcare professional regarding any questions you may have about your menstrual health, and never disregard professional advice or delay seeking it because of something you read in the Application.
No Guarantee of Results; Assumption of Risk
The Service Provider makes no representation or warranty that any forecast, phase, or suggestion in the Application will be accurate for your body or appropriate for your circumstances. Cycles vary between individuals and the Application's forecast is a rule-based estimate, not a measurement. You use the Application's content voluntarily and at your own risk, and you are solely responsible for evaluating whether any suggestion is appropriate before acting on it.
Indemnification
You agree to indemnify and hold harmless the Service Provider from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the Application or your reliance on its content, except to the extent such claims arise from the Service Provider's own negligence or willful misconduct.
Limitation of Liability
To the fullest extent permitted by law, the Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption.
The Service Provider retains full liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and any other liability that cannot be excluded or limited under applicable law.
Governing Law
These Terms and Conditions are governed by the laws of the jurisdiction in which the Service Provider is established, excluding conflict of law rules, except to the extent mandatory consumer protection laws provide otherwise.
Changes to These Terms
The Service Provider may periodically update these Terms and Conditions. You are advised to review this page regularly for any changes. Previous versions are available upon request by contacting tsimafei.lemeshchanka@gmail.com.
